Why does my firm have to pay for the skip trace if you are unable to locate or confirm the location of the individual?

There is a certain level of intelligence gained by an unsuccessful skip trace. You learn that the subject of the investigation may be transient or purposely obscuring his/her location for a number of reasons. You can be assured that all the basic steps and top level data sources, both private and public, have been accessed in order to locate the person. We often put in more time and utilize more resources in attempting to locate the more difficult skips. The other important factors are the commonness of the name and the number of provided identifiers such as date of birth, social security number, spouse name, or former addresses. The more data you provide to us, the better chance of a successful skip trace.

In years past, we have typically relied on a telephone listing, whether published or non-published, for the individual to confirm residence at a given address. The proliferation of cellular telephones and drop off in use of land line residential telephones make it more difficult to confirm an individual's location. We will often attempt to confirm a residence via contact with neighbors.

 
Are there additional ways in which I can locate hard to find witnesses whose whereabouts cannot be ascertained by the skip trace?

On our Skip Trace Form there is a section wherein you can authorize an additional 2 hours minimum investigation at $75.00 per hour for a total of $150.00.

We suggest that you order the basic skip trace first and then utilize the additional investigation if needed. Often, we suggest that the law firm attempt service of process if that is required at the address that we provide in the basic skip trace,even if unconfirmed. If it is apparent through your process server's efforts that the subject is not at that location, then we recommend the additional 2 hour investigation. Do you believe the old adage about lawyers: "You're only as good as your last case"?
We don't! We know many fine attorneys who occasionally lose cases. They may be prepared with the law, the facts and the right witnesses but they still may lose. Jurors can be unpredictable and judges can rule adversely and upset your case. Do you really want to be judged by that last case that you lost? Please keep this in mind if we are unable to locate your witness. Just like the factors that you can not control during trial, investigators can run into factors that we can not control. The subject may have recently moved into an apartment or house where nothing is in his/her name. They may live in the very address that you initially provided to us as the last known but family or roommates are lying to your process server. They may have so much debt that they are purposely obscuring their whereabouts. If we don't nail the first skip trace, please give us a chance to prove ourselves with a second, third and hopefully many more assignments. We win a lot more than we lose. If a case has already been worked by your office staff or another investigator and you get a negative result, the basic skip trace may not be sufficient to locate the witness. You may need to order the second level search or possibly do more depending upon the degree of difficulty and the importance of the witness. Let's face it: some are easy to find and others are much more difficult.
